This Privacy Policy explains how Demand Trail LLC, operating Demand Trail, collects, uses, shares, and protects Personal Data when we act as a controller or business responsible for deciding why and how Personal Data is processed.

This Privacy Policy applies when you visit our websites, create or administer an account, communicate with us, purchase or evaluate the Services, receive our business communications, or use portions of the Services where Demand Trail acts as a controller.

This Privacy Policy does not govern Customer Personal Data that Demand Trail processes on behalf of a Customer as a processor or service provider. For that data, the Customer determines the purposes and means of processing and its own privacy notices apply. The Demand Trail Data Processing Addendum governs our processing obligations to the Customer.

Demand Trail LLC is the controller of Personal Data covered by this Privacy Policy unless a different Demand Trail affiliate or entity is identified at the point of collection.

Demand Trail generally acts as a controller for website visitors, account administrators, billing contacts, prospective customers, business contacts, and individuals who communicate directly with us about Demand Trail.

Demand Trail generally acts as a processor or service provider when a Customer uploads, creates, imports, connects, or otherwise processes CRM records and other Customer Personal Data through the Services. Examples may include lead records, contact records, opportunity records, activity history, workflow data, imported lists, and communications processed on Customer instructions.

If you are an individual whose data has been entered into Demand Trail by one of our Customers, you should generally direct privacy requests to that Customer. We will assist Customers with requests as required by the DPA and applicable law.

Account and profile information, such as name, business email, job title, organization, authentication information, preferences, and account identifiers.

Commercial and billing information, such as subscription, plan, transaction, invoice, billing contact, and payment status information. Payment card details may be collected directly by our payment processor rather than stored by Demand Trail.

Communications information, such as support requests, sales conversations, survey responses, feedback, and records of communications with us.

Device and usage information, such as IP address, browser type, device identifiers, operating system, pages or features used, timestamps, diagnostic events, and security logs.

Website and cookie information, such as cookie identifiers, referral information, and preferences, subject to the Cookie Policy and applicable consent requirements.

Integration and configuration metadata needed to connect or operate Connected Services. We limit collection to information reasonably necessary for the integration and Service operation.

We collect Personal Data directly from you, from your organization or account administrator, automatically through our websites and Services, from Connected Services you choose to use, from service providers, and from lawful business sources used for sales, security, fraud prevention, and account administration.

To provide, operate, maintain, support, secure, and improve the Services.

To create and administer accounts, subscriptions, billing, authentication, and customer relationships.

To communicate about the Services, support requests, security, changes, transactions, and account administration.

To understand product usage, troubleshoot issues, prevent fraud and abuse, monitor reliability, and improve user experience.

To market Demand Trail to businesses and measure our marketing where permitted by law, subject to applicable opt-out rights.

To comply with legal obligations, enforce agreements and policies, establish or defend legal claims, and protect rights, safety, and security.

Where applicable law requires a legal basis, we process Personal Data as necessary to perform a contract, take steps at your request before entering a contract, comply with legal obligations, pursue legitimate interests that are not overridden by applicable rights, or based on consent where consent is required.

Legitimate interests may include providing and improving business services, securing systems, preventing abuse, managing customer relationships, and conducting appropriate business-to-business marketing.

We may share Personal Data with service providers and subprocessors that perform hosting, security, support, communications, analytics, billing, authentication, or other functions for Demand Trail under appropriate contractual restrictions.

We may share information with professional advisers such as lawyers, accountants, auditors, insurers, and financial institutions when reasonably necessary.

We may disclose information to comply with law, lawful process, regulatory requirements, or valid government requests, or to protect rights, safety, security, and the integrity of the Services.

We may transfer Personal Data in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction, subject to appropriate confidentiality and legal requirements.

We may share Personal Data with your consent or at your direction.

Customer Personal Data is controlled by the applicable Customer. Demand Trail processes that data according to the Customer's instructions, the Agreement, the DPA, and applicable law.

Demand Trail does not independently determine the Customer's audience selection, sales purpose, marketing purpose, lawful basis for contacting a person, or other business purpose for Customer Personal Data except where required to provide, secure, or comply with the Services and law.

The public website currently uses cookies and similar technologies only where needed for strictly necessary functions and security. The Cookie Policy describes current use and available controls.

Demand Trail and its service providers may process Personal Data in countries other than the country where it was collected. Where required, we use recognized transfer mechanisms and contractual safeguards, which may include Standard Contractual Clauses or other lawful mechanisms.

We retain Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business and transaction records, comply with legal obligations, resolve disputes, enforce agreements, and protect security.

Customer Personal Data is retained and deleted according to the Agreement, DPA, Customer instructions, product settings, backup practices, and applicable law.

We use reasonable administrative, technical, and organizational safeguards designed to protect Personal Data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Depending on your location, you may have rights to request access, correction, deletion, portability, restriction, or objection, and rights relating to consent or certain automated processing. You may also have a right to appeal a decision or lodge a complaint with a supervisory authority.

To submit a request relating to Personal Data for which Demand Trail is the controller, contact privacy@demandtrail.com. We may need to verify your identity before completing a request.

For Customer Personal Data, contact the applicable Customer first. If you send the request to us, we may refer it to the Customer or assist the Customer as required by law and the DPA.

You may opt out of non-transactional Demand Trail marketing emails using the unsubscribe link in the message or by contacting us. We may continue sending service, security, billing, legal, and account communications that are necessary to our relationship with you.

Demand Trail is a business service and is not directed to children. We do not knowingly collect Personal Data from children through the public website in circumstances where parental consent would be required. If you believe a child has provided Personal Data directly to us, contact privacy@demandtrail.com.

Demand Trail will provide additional jurisdiction-specific disclosures when required by applicable law.

We may update this Privacy Policy from time to time. We will update the Last Updated date and provide additional notice when required by law or when changes are material.
